Refund Policy

Last updated: April 2026

At Party Affairs by D&S, we take great care in planning and preparing décor for each event. Many of our services involve customised designs, time reserved for your booking, and materials purchased in advance. This Refund Policy explains when refunds may apply, including your rights under the Australian Consumer Law (ACL).

1) Your Rights Under Australian Consumer Law (ACL)

Our services come with consumer guarantees under the ACL. These rights cannot be excluded by any policy or terms and conditions. [accc.gov.au], [accc.gov.au]

If there is a problem with a service, the remedy depends on whether the issue is a major or minor failure:

Major failure (services)

If a service has a major problem, customers may have the right to cancel the service and may be entitled to a refund or other remedy depending on the circumstances. [accc.gov.au], [consumerpr….wa.gov.au], [nsw.gov.au]

Minor failure (services)

If a problem is minor, the business generally must be given an opportunity to fix the issue within a reasonable time (for example, correcting or re-supplying the relevant part of the service). [accc.gov.au], [consumerpr….wa.gov.au]

A business may also have the right to assess the issue before providing a remedy. [accc.gov.au], [nsw.gov.au]

2) Change of Mind / Cancellations (Not Due to a Fault)

If you cancel or change your mind (for reasons not related to a fault or failure to meet consumer guarantees), refunds are handled under our booking terms and preparation costs.

Because we reserve your date and often purchase items or begin preparation, a refund may be limited or not available in some circumstances. This is separate from (and does not affect) your ACL rights if our goods/services are faulty or not as described. [accc.gov.au], [accc.gov.au], [consumer.vic.gov.au]

3) Deposits & Booking Fees

If a deposit or booking fee is required, it is used to:

  • secure your event date/time,
  • cover planning and admin time, and
  • contribute to materials or supplier commitments (where applicable).

Deposits are commonly treated as non-refundable for cancellations/change of mind, provided the terms are clear and reasonable. Labelling something “non-refundable” does not remove ACL rights where a consumer guarantee is not met. [sprintlaw.com.au], [accc.gov.au]

4) Refunds Where We Cancel (or Cannot Deliver)

If Party Affairs by D&S cancels your booking or cannot provide the service due to unforeseen circumstances, you will be offered an appropriate remedy, which may include a full refund of amounts paid for undelivered services, or rescheduling by agreement. [accc.gov.au], [nsw.gov.au]

5) Problems With Goods Used in Your Setup (e.g., décor items)

If your booking includes goods supplied as part of the décor service and those goods have a major problem, consumers may be entitled to a remedy (such as refund/replacement), depending on the circumstances. [accc.gov.au], [accc.gov.au], [nsw.gov.au]

6) How Refunds Are Processed

  • Approved refunds are processed to the original payment method where possible.
  • Processing times can vary depending on your bank/payment provider.

7) How to Request a Refund or Remedy

To help us resolve issues quickly, please contact us with:

  • your name and event date,
  • a short description of the issue,
  • photos (if relevant), and
  • what outcome you are requesting.

We will respond within a reasonable timeframe and work with you toward an appropriate resolution consistent with ACL requirements. [accc.gov.au], [nsw.gov.au]
